Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the Super Vitals platform — including the mobile application (Android/iOS) and web application — you agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

If you are using the Service on behalf of an organisation (a clinic, hospital, or healthcare practice), you represent that you have the authority to bind that organisation to these Terms.

If you do not agree to these Terms, do not use the Service.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:

• Provide accurate, current, and complete information when registering.
• Promptly notify us of any unauthorised access to your account at info@humanmindlabs.com.
• Not share your account credentials with any other person.
• Not create multiple accounts or create an account on behalf of another person without authorisation.

We reserve the right to disable accounts that violate these Terms or that have been inactive for an extended period following notice to you.

• Nothing on the Service constitutes professional medical advice, diagnosis, or treatment.
• Always seek the advice of a qualified healthcare professional with any questions you may have regarding a medical condition.
• Never disregard professional medical advice or delay seeking it because of information on this platform.
• No doctor-patient relationship is created solely by use of this platform.
• In a medical emergency, call emergency services immediately. Do not rely on this platform for emergency medical assistance.

6. Intellectual Property

All intellectual property rights in and to the Service — including the software, algorithms, design, trademarks, logos, and content created by us — are and shall remain the exclusive property of Human Mind Labs Private Limited and are protected under applicable Indian and international intellectual property law.

These Terms do not grant you any right to use our name, trademarks, logos, or other proprietary materials without our prior written consent.

7. Your Content

You retain full ownership of all health data, documents, records, and other content you upload or create on the Service (“Your Content”).

By uploading or submitting Your Content, you grant Human Mind Labs Private Limited a limited, non-exclusive, royalty-free licence to store, process, and display Your Content solely to provide the Service to you. This licence terminates when you delete Your Content or close your account.

You represent and warrant that you have all rights necessary to upload Your Content and that doing so does not violate any third-party rights or applicable law.

8. Third-Party Services

The Service uses third-party providers for cloud storage, push notifications, and hosting. Your use of the Service is also subject to the terms and privacy policies of these providers.

The Service may contain links to third-party websites or services. We do not control these external services and are not responsible for their content, practices, or policies.

The Service is distributed via the Google Play Store and Apple App Store. Your use of those platforms is subject to their respective terms of service.

9. Limitation of Liability

The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Our total aggregate liability to you for any claim arising under these Terms or relating to the Service shall not exceed the total fees you paid to us (if any) in the 12 months preceding the claim, or ₹1,000 — whichever is greater.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, applicable law, or have engaged in conduct harmful to the Service, other users, or third parties.

You may stop using the Service at any time. To request permanent account and data deletion, email info@humanmindlabs.com with the subject line “Account Deletion Request”. We will delete your account and all associated data within 30 days.

Sections 5 (Health Disclaimer), 6 (Intellectual Property), 9 (Limitation of Liability), and 11 (Governing Law) survive termination of these Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of laws provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties.

If negotiation fails within 30 days, the dispute shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

12. Changes to These Terms

We may revise these Terms from time to time. For material changes, we will provide at least 7 days' advance notice via push notification or email before the changes take effect, and update the “Last updated” date above.

Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and request account deletion.
